Terms and conditions of sale

1. Purpose and parties

These terms govern the sale of access to the PROMACEO LEAN online training platform, published by PROMACEO SAS (RCS Amiens 131 245 615, registered office A202 – 132 avenue Valéry Giscard d'Estaing, 80000 Amiens, VAT FR83131245615), hereinafter "PROMACEO", to any adult natural person acting in a personal or professional capacity, hereinafter "the Customer". Purchasing constitutes unreserved acceptance of these terms.

2. Description of the service

Each program includes lessons, graded multiple-choice quizzes, numerical case studies, a timed mock exam and, upon passing it (score ≥ 70%), a personal PDF certificate. The detailed content (number of lessons and questions, body of knowledge followed, access period) is shown on each program's page at the time of ordering.

The service is private training. The certificate is not a professional certification and confers no rights with third-party organisations. Ten discovery questions per program are available free of charge and without an account.

3. Prices

Prices are stated in euros, inclusive of all taxes (French VAT at the applicable rate). The applicable price is the one displayed at the time of ordering. Payment is one-time; there is no subscription and no tacit renewal. PROMACEO may change its prices at any time for future orders.

4. Ordering and payment

Ordering requires an account (name, e-mail address, password). Payment is processed by the provider Mollie B.V. (Amsterdam), by card or any other method offered, on a secure page. PROMACEO has no access to card details. The order becomes binding upon confirmation of payment by the provider; access is then opened immediately and a confirmation e-mail is sent with the link to the invoice.

5. Right of withdrawal

The service is digital content not supplied on a tangible medium, the performance of which begins immediately after payment. In accordance with Article L221-28 13° of the French Consumer Code, the consumer Customer expressly requests, at the time of ordering, immediate performance and acknowledges that they thereby lose their fourteen-day right of withdrawal. This request is collected through a separate checkbox, and PROMACEO retains proof of it.

If the Customer does not wish to waive their right of withdrawal, they may write to us before making any payment to arrange a deferred opening of access.

6. Duration and scope of access

Access is personal, in the Customer's name and non-transferable. It is opened for the period stated on the program (1, 3 or 12 calendar months) from confirmation of payment. Upon expiry, the content is no longer accessible; certificates obtained remain downloadable and verifiable, and personal notes may be exported before expiry. A new purchase of the same program extends access from the current expiry date.

The Customer shall not share their login details, reproduce or extract the content, or use automated means of access. In the event of a breach, PROMACEO may suspend access without refund after a formal notice has remained without effect for 7 days.

7. Availability and support

PROMACEO strives to ensure continuous availability of the service, subject to maintenance operations and force majeure. Support is provided by e-mail at contact@promaceo.fr, with a response within 3 business days. In the event of a technical fault attributable to PROMACEO that prevents access to the content and is not resolved within 7 days of being reported, the Customer may request a full refund of the order concerned.

8. Certificate

The certificate is generated automatically upon passing the mock exam, in the name recorded in the account at the time of passing. It bears a unique identifier and a QR code linking to a public verification page showing the program, the holder's name, the score and the date. The Customer may request that their name not be published on the verification page. PROMACEO reserves the right to revoke any certificate obtained by fraud.

9. Liability

The learning content is written with care from public bodies of knowledge, but PROMACEO guarantees neither success in any third-party exam nor the content's conformity with future changes to those references. PROMACEO's liability is limited to the amount of the order concerned, except where mandatory legal provisions provide otherwise.

10. Personal data

The processing of personal data is described in the privacy policy, which forms part of these terms.

11. Mediation and governing law

These terms are governed by French law. In the event of a dispute, the consumer Customer may refer the matter free of charge to the consumer mediator to which PROMACEO belongs: [mediator to be appointed — contact details to be completed before sales open], or to the European Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr. Failing an amicable settlement, the French courts have jurisdiction; for business customers, the Commercial Court of Amiens (tribunal de commerce d'Amiens).

12. Translations

These terms are drawn up in French. Translations are provided for convenience only; in the event of any discrepancy, the French version prevails.
